Description

AI systems are increasingly fueling the entire creative value creation process, from the creation of intellectual works to their exploitation, as this process shifts to the digital space. This raises numerous legal questions. The research project Artificial Intelligence Law and Policy (AILP) takes a holistic, transdisciplinary approach to classifying and assessing AI in applicable law. The project aims to examine the extent to which AI systems can and should be used in accordance with applicable law on a case-by-case basis, as well as whether applicable law leaves questions open that require regulation. This is particularly relevant to issues of intellectual property, such as property rights to or through input or output from AI systems. In view of technological developments, the suitability of certain traditional concepts of intellectual property law can be critically questioned. We examine regulations tailored to AI systems in terms of how they are dogmatically embedded and how they affect legal practice in terms of their regulatory objectives.
